Terms of Service

1. ACCEPTANCE OF TERMS: Nen Multimedia welcomes you! Nen Multimedia provides its services subject to the following Terms and Conditions, which may be updated by us from time to time without notice.

2. RESERVATIONS: Upon clicking "I agree" Nen Multimedia reserves the time and date agreed upon, and will not make other reservations at this time and date. No availability of date will be guaranteed without the $99.00 booking deposit. I understand that I am required to contact Nen Multimedia by phone approximately fourteen (14) calendar days prior to the event to discuss any last minute modifications that may have occurred since signing the contract. Once you have confirmed your initial package, you may adjust your package but the price will remain the same or rise accordingly. Any adjustments to your package must be made no later than fourteen (14) calendar days prior to the event, otherwise we cannot guarantee your requests. Adjustments to your package must be equal or higher in value to last modifications made. We are not responsible to execute taping any occurrence before, during or after the event not outlined to be taped within the contract details. I understand that Nen Multimedia reserves the right to cancel my reservation, and if such occurs Nen Multimedia will refund all my money in full after seven (7) business days.

3. PAYMENT PLANS: The payment plan choices are as follows: If you choose “Payment Plan #1” then you qualify to receive a 5% discount on your order. “Payment Plan #1” requires that you initially reserve your date for the amount of $99.00. Then compensate the total balance of the package you choose within (30) days thereafter or earlier. In the event that payment is late the 5% discount is disqualified and client is defaulted to “Payment Plan #3” and its terms and conditions. If you choose “Payment Plan #2” then you are required to initially reserve your date for the amount of $99.00. The balance of the package you choose is divided into three (3) payments thereafter. With the initial payment due four (4) months prior to event. Then the second payment due two (2) months prior to event. And finally, two (2) weeks (14 calendar days) prior to event. Failure to compensate these payments on their due dates makes you subject to a late penalty of 10%-15% of total balance for each missed payment. Late payments are then added on the following billing cycle. An additional $6.27 processing fee is charged for each payment. If you choose “Payment Plan #3” then you are required to initially reserve your date for the amount of $99.00. Then the balance of the package you choose is divided into monthly payments according to the number of months remaining up to the date of your event. The initial payment is due thirty (30) days after booking and the last payment is due two (2) weeks (14 calendar days) prior to event. Failure to compensate these payments on their due dates makes you subject to a late penalty of 10%-15% of total balance for each missed payment. Late payments are then added on the following billing cycle. An additional $6.27 processing fee is charged for each payment. Nen Multimedia retains rights to approve or deny services outlined in this document if balance is not paid by (14) calendar days prior to the scheduled event, and Nen Multimedia may consider payment failure as a cancellation and thus apply the terms described in condition #5.

4. DEPOSIT: The monies received for reserving your date is a booking deposit. This is a $99.00 (refundable only in the “Nen Multimedia Gift Card”) booking deposit in order to reserve your event date. The remaining balance is due fourteen (14) calendar days prior to the date of event or according to the payment plan as decided upon booking.

5. CANCELLATIONS: In the event of a postponement or cancellation of contract by client, client will recieve 70% monetary refund and 30% refund in the “Nen Multimedia Gift Card.” The “Nen Multimedia Gift Card” which client or anyone can utilize in future orders, is not refunded in cash. Nevertheless, we will furnish you 100% cash-back if we are able to replace the date with another booking. Any cancellations must be reported no later than fourteen (14) calendar days prior to the event, otherwise your refund shall be a prorated amount of the package selected, solely based on the discretion of Nen Multimedia.

6. LIMIT OF LIABILITY: Nen Multimedia takes utmost care with respect to capturing live video for production delivering quality product and services ordered. Nevertheless, if Nen Multimedia fails to comply with the terms of this agreement due to any event or at beyond the control of Nen Multimedia, including but not limited to illness, accidents, labor disputes, acts of God and other catastrophes, or uncontrollable and unforeseeable equipment failure, Nen Multimedia's maximum liability is limited only to refund of all monies received. The limit of liability partial loss shall be a prorated amount of the package selected, based on the percentage of loss at the discretion of Nen Multimedia.

7. PERFORMANCE: Nen Multimedia reserves the right to assign an alternative videographer to shoot the video in the event of illness or other unforeseen circumstance that may arise beyond our control. In such an event Nen Multimedia shall warrant the alternative videographer to be a competent professional.

8. EDITING: In most cases our turn around time will be approximately six (6) to twenty-four (24) weeks. This contract furnishes Nen Multimedia with full rights to edit and arrange your event in the manor we find best. Any modification to the actual content of your video production is solely up to Nen Multimedia. In the event a particular segment of the event is either not recorded, partially recorded, or not a part of the edited master tape, it is at the sole discretion of Nen Multimedia as the exclusive producer of the event video recording. We retain the right to refuse reedits/modifications of any project. You have 7 (seven) days from the delivery date of your finished product to report and problems. Any additional modifications or corrections in finished video that is not due to the fault of Nen Multimedia will be charged at a rate of $50 per hour.

9. DVD PERFORMANCE: Client is aware that DVD-R discs can be played on most home DVD players made today; nevertheless, there are compatibility issues with some machines. All DVD-R discs do not play in all DVD players. The Client releases Nen Multimedia from any liability for any incompatibility issues.

10. PRODUCTION CONFLICTS: It is understood that Nen Multimedia is the exclusive videographer retained by the client to cover each event. Any conflicts with other photographic and/or video coverage contracts and any notifications necessary to avoid such conflicts are the sole responsibility of the client.

11. CLIENTS RESPONSIBILITY: Client assumes all responsibility for obtaining any necessary permission, clearance permits, etc., which may be required for Nen Multimedia to videotape each event, public or private. Client is solely responsible for any parking, admission fees, passes, tickets, etc. necessary for Nen Multimedia to gain access to and videotape each event. Client assumes all responsibility for obtaining and retaining permission for access to any requested camera positions and is solely responsible for the quality of the final production resulting from the utilization of, or inability to utilize, such requested camera positions.

12. WITHDRAWAL: Nen Multimedia reserves the right to remove equipment and personnel from any event for any reason in the event of, in the opinion of the Nen Multimedia crew chief, there is sufficient potential to cause equipment damage or personal injury to the Nen Multimedia crew.

13. PROVISIONS: Durning the time that video coverage time is over 4 hours, food will be provided for the videographer and assistants during the guest meal service. (Same food you eat at reception).

14. RELEASES: Client hereby releases and authorizes Nen Multimedia to utilize images, names, sounds, etc. of each event and any reproductions and/or recordings of same in connection with any contest, exhibition, display, advertising promotion, newsletter, publication inclusion in demonstration tape or other purposes. In return, Nen Multimedia agrees to utilize same in good faith and good taste. Unless otherwise specifically stated herein, the raw footage and masters remain the property of Nen Multimedia and Nen Multimedia has the exclusive right to make additional reproductions from them for the Client.

15. PARTICIPANTS RELEASES: Client warrants that all participants in each non-public event freely furnish their consent to being recorded (videotaped) as part of each such production and consent to the same good-faith usages of their likeness images and/or voices are previously described in condition #11. Client assumes responsibility for such release and authorization, and for notification to all participants.

16. DEADLINE: Nen Multimedia will do its best to complete all projects within six to twenty-four weeks from the latter date of either the event date or date client delivers all materials necessary to complete the project. The completion period is only an approximate length of time and any longer periods necessary for completion will not void this contract. Nen Multimedia will notify client of such circumstances and try to furnish client a new approximate completion date.

17. PROPERTY DAMAGE: All personal property provided by client to Nen Multimedia for utilization in the post-production of their movie is received by Nen Multimedia at the complete and total risk of client. Nen Multimedia will make every effort to insure the safekeeping of client’s personal property while in its possession and return same to client upon delivery of the edited master copy tape.

18. PROTECTION: Nen Multimedia will not be responsible for the storage and safekeeping of any tapes associated with this project.

19. VALIDITY: If any portion of this agreement should be determined to be invalid, it is agreed that the invalidity of such portion shall not affect the validity of the remaining portions of this agreement.
